Paid Services – Yacht Charter Brokerage
Brokerage Role
Pobat Charter acts solely as an independent yacht charter broker and intermediary between customers and third-party yacht owners, fleet operators, charter companies, skippers, and related service providers (“Suppliers”).
We do not:
- Own, operate, manage, or crew yachts
- Act as a maritime carrier
- Control yacht maintenance or seaworthiness
The charter agreement is concluded directly between the customer and the relevant Supplier. Pobat Charter is not a party to the charter contract.
Booking Confirmation
A booking is confirmed only when:
- The Supplier confirms availability;
- The customer signs or accepts the Supplier’s charter agreement; and
- The required payment is made within the stated deadline.
Failure to comply may result in cancellation by the Supplier.
Payments
Payment schedules are determined by the Supplier and typically include:
- An initial deposit (usually 30–50%) upon booking
- The remaining balance prior to embarkation (typically 30–60 days before charter start)
Payments may be collected by us on behalf of the Supplier or paid directly to the Supplier.
Quoted prices may exclude:
- Security deposit
- APA (Advance Provisioning Allowance)
- Fuel
- Port and marina fees
- Skipper or crew fees
- Cleaning fees
- Local taxes
- Optional extras
Unless explicitly stated, such costs are not included.
We are not responsible for currency fluctuations, banking fees, or transaction delays.
Security Deposit
Most charters require a refundable security deposit payable to the Supplier.
The deposit:
- Is held by the Supplier (not Pobat Charter)
- Covers damages, losses, or contractual breaches
- Is refunded in accordance with the Supplier’s policy
We bear no responsibility for deposit deductions or related disputes.
Cancellation and Refund Policy
Cancellations and refunds are governed exclusively by the terms of the Supplier’s charter agreement.
By proceeding with a booking, you acknowledge that:
- Pobat Charter is not the service provider of the charter;
- Cancellation conditions are set by the Supplier;
- Refund eligibility depends solely on the Supplier’s contractual terms.
Typical industry practice (for reference only) may include partial or full cancellation penalties depending on timing before embarkation, but actual terms vary by Supplier.
Any cancellation request must be submitted in writing. We will forward the request to the Supplier and assist with communication.
We strongly recommend obtaining adequate travel and charter cancellation insurance.
Use Restrictions
You agree not to:
- Use the website for unlawful or fraudulent purposes
- Attempt unauthorized access to the website
- Interfere with website security
- Copy, reproduce, distribute, or exploit website content commercially
- Use automated systems (scraping, crawling, mining) without permission
- Use our name, trademarks, or branding without written consent
We reserve the right to restrict access for violations.
Intellectual Property

If liability is imposed despite the above limitations, Pobat Charter’s total aggregate liability shall not exceed the brokerage commission actually received by Pobat Charter in connection with the relevant booking
Indemnification
You agree to indemnify and hold Pobat Charter harmless from any claims, damages, or expenses arising from:
- Your breach of these Terms
- Your violation of any law
- Your conduct during a charter
- Claims brought by third parties in connection with your actions
Jurisdiction and Dispute Resolution
These Terms are governed by the laws of the State of Israel.
Any dispute relating to the website or brokerage services shall be subject to the exclusive jurisdiction of the competent courts of Tel Aviv, Israel.
Disputes arising from the charter itself shall be governed by the law specified in the relevant Supplier’s charter agreement.
Miscellaneous
Entire Agreement: These Terms constitute the entire agreement regarding website use and brokerage services.
Assignment: You may not assign your rights without our consent.
Severability: If any provision is invalid, the remaining provisions remain in effect.
No Waiver: Failure to enforce any provision does not constitute a waiver.
